These terms are an agreement between you and Mentor Pods, the operator of MedCheck. By using MedCheck you agree to them. If you do not agree, please do not use MedCheck. Questions go to matt@mentorpods.com.
1. The service is free
MedCheck is provided free of charge. There is no subscription and no credit card. We may change, limit or stop any part of the service at any time.2. General information only, not medical advice
MedCheck helps you organize the medicines you already take and shows general information about side effects and interactions so you can ask better questions. It is not medical advice, not a diagnosis and not a treatment plan. Using MedCheck does not create a doctor and patient relationship with anyone. No pharmacist or physician reviews your list.3. Not for emergencies
Never use MedCheck in an emergency. If you think you are having a medical emergency, call 911 or go to the nearest emergency room right away.4. Always talk to your doctor or pharmacist
Always consult your doctor or pharmacist before you start, stop, change or combine any medicine, and before you act on anything you see in MedCheck.5. AI results can be wrong
Medicine details, side effect rates and interaction severities in MedCheck are produced by AI systems and checked by a second AI pass. They can still be incomplete, outdated or wrong. Percentages and risk labels are approximations, not predictions about you personally.6. You must be 18 or older
You may use MedCheck only if you are 18 or older and able to enter this agreement.7. Your account and your information
Keep your Google sign in secure. You are responsible for everything done in your account. You are responsible for the accuracy of everything you enter, including medicine names, doses and schedules. If you enter information about another person, you confirm that you have that person's permission or the legal authority to act for them.8. Administrators can view your data
Platform administrators can access and view all account data, including medication lists, for support, security, quality and the operation of the service. See the Privacy Policy for details.9. Use of data to improve the service and train AI
By using MedCheck you consent to your data, including medication information, being used to improve the service and to train and improve AI models, in de identified form where practical. We do not sell, rent or trade personal information.10. Acceptable use
- Do not use MedCheck for anything unlawful or harmful.
- Do not try to access another person's account or data.
- Do not probe, scan, overload or interfere with the service, and do not scrape it in bulk or use it to build a competing dataset.
- Do not upload malicious code or misuse the AI lookups.
We may suspend or end access to any account that breaks these rules.
11. Our content
MedCheck, its name, design, text and software are owned by Mentor Pods and protected by law. You keep whatever rights you have in the information you enter, and you grant us the license described above so we can operate and improve the service.12. No warranty
MedCheck is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non infringement. We do not warrant that the service will be uninterrupted, error free, complete, current or medically accurate.13. Limitation of liability
To the fullest extent allowed by law, Mentor Pods and its owners, members, employees and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any lost profits, lost data, personal injury, or any harm arising from your use of, or inability to use, MedCheck, even if we were told such damages were possible. To the fullest extent allowed by law, our total liability for all claims relating to MedCheck will not exceed one hundred United States dollars (100.00 USD), which reflects that the service is provided free of charge. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.14. Indemnification
You agree to defend, indemnify and hold harmless Mentor Pods and its owners, members, employees and service providers from any claims, damages, losses, liabilities and expenses, including reasonable legal fees, arising from your use of MedCheck, from information you entered, from your breach of these terms, or from your entering another person's information without permission.15. Deleting your account
You can delete your account and all of your data at any time from Settings inside the app, using the button called "Delete my account and all data". You may also stop using MedCheck at any time. We may end or suspend your access if you break these terms or if we stop offering the service.16. Governing law
These terms and any dispute about them or about MedCheck are governed by the laws of the State of Ohio, United States, without regard to conflict of law rules.17. Arbitration and class action waiver, with an opt out
If we cannot resolve a dispute informally, you and Mentor Pods agree that the dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its consumer rules, seated in Ohio or conducted by phone or video, rather than in court. Either side may still bring an individual claim in small claims court.
You and Mentor Pods each waive any right to a jury trial and agree that claims may be brought only in an individual capacity, not as a plaintiff or class member in any class, consolidated or representative proceeding.
You may opt out of this arbitration section. Send an email to matt@mentorpods.com with the subject "Arbitration opt out" and your account email within 30 days of first accepting these terms. If you opt out, disputes will be resolved in the state or federal courts located in Ohio, and the class action waiver in this section will not apply to you.
18. Changes to these terms
We may update these terms. We will update the effective date at the top and, for meaningful changes, ask you to accept the updated version the next time you sign in. Continuing to use MedCheck after a change means you accept it.19. Severability and entire agreement
If any part of these terms is found unenforceable, the rest stays in force and the unenforceable part is limited to the smallest extent needed. These terms and the Privacy Policy are the entire agreement between you and Mentor Pods about MedCheck. Our not enforcing a right is not a waiver of it.20. Contact
